Welcome to The Ark! By accessing or using The Ark, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use The Ark.
Use of the App

1. Eligibility
- You must be at least 12 years old to use The Ark. If you are under 18, you must have the consent of a parent or guardian.

2. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate, complete, and up-to-date information when creating an account.
- You must not share your account with others or use another person’s account without permission.

3. Prohibited Activities
- You may not use The Ark for any illegal or unauthorized purpose.
- You may not interfere with or disrupt The Ark’s functionality, servers, or networks connected to The Ark.
- You may not upload or distribute malicious software or content that violates intellectual property rights.

Intellectual Property

- All content, trademarks, and materials within The Ark are the property of The Ark or its licensors. You may not reproduce, distribute, or modify any part of The Ark without prior written permission.
- You retain ownership of any content you create or submit within The Ark, but you grant The Ark a non-exclusive license to use, display, and distribute such content for the purpose of operating The Ark.

Limitation of Liability

- The Ark is provided on an "as-is" and "as-available" basis. We make no warranties of any kind regarding the App’s functionality, availability, or accuracy.
- To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, or consequential damages arising from your use of The Ark.

Indemnification

You agree to indemnify and hold harmless The Ark, its affiliates, and its employees from any claims, damages, or expenses arising out of your use of The Ark or violation of these Terms.

Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in any activity that disrupts the The Ark’s operations. Upon termination, your right to use The Ark will cease immediately.

Governing Law

These Terms are governed by and construed in accordance with the laws of USA/CA, without regard to its conflict of law principles.

Dispute Resolution

Any disputes arising out of or relating to these Terms or The Ark will be resolved through binding arbitration in the United States, unless otherwise required by law.

Changes to These Terms

We may update these Terms from time to time. Continued use of The Ark after changes are made constitutes acceptance of the updated Terms. We encourage you to review these Terms regularly.
